Description
Arbitration is a formal method of alternative dispute resolution (ADR) involving a neutral third party who makes a binding decision. The dispute will be decided by one or more persons, which renders the 'arbitration award'. An arbitration decision or award is legally binding on both sides and enforceable in the courts, unless all parties stipulate that the arbitration process and decision are non-binding.
माध्यस्थम (arbitration) एक वैकल्पिक विवाद समाधान प्रक्रम है जिसमें पक्षकर किसी तीसरे व्यक्ति के हस्तक्षेप के माध्यम से तथा न्यायालय का सहारा लिए बिना अपने विवादों का निपटान करवाते हैं। यह ऐसी विधि है जिसमें विवाद किसी नामित व्यक्ति के सामने रखा जाता है जो दोनों पक्षों को सुनने के पश्चात अर्ध-न्यायिक तरीके से मसले का निर्णय करता हैं। उदाहरणार्थ 'पंच' या 'पंचायत' को कोई विवाद संदर्भित करना माध्यस्थम का एक रूप है। सामान्यत:, विवादकारी पक्ष अपना मामला किसी माध्यस्थम न्यायाधिकरण को संदर्भित करते हैं तथा न्यायाधिकरण द्वारा लिया गया निर्णय 'अवार्ड' कहलाता है। माध्यस्थम का प्रयोग मुख्यत: व्यापार क्षेत्रों में किया जाता है जैसे निर्माण परियोजनाएं, नौवहन तथा संवहन, पेटेंट, कारोबार चिह्न तथा ब्रांड, वित्तीय सेवाएं जिनमें बैंकिंग तथा बीमा शामिल है, विदेशी सहयोग, भागीदारी विवाद इत्यादि।
