At common law, damages are a remedy in the form of a monetary award to be paid to a claimant as compensation for loss or injury. To warrant the award, the claimant must show that a breach of duty has caused foreseeable loss. To be recognised at law, the loss must involve damage to property, or mental or physical injury; pure economic loss is rarely recognised for the award of damages.

क्षतिपूर्ति किसी अन्य व्यक्ति के व्यवहार से जब किसी को कुछ हानि पहुँचती है तब उसमें एक स्वाभाविक प्रतिक्रिया यह जानने की होती है कि इसका उपचार क्या होगा? विधि का यह अंतर्निहित कर्तव्य है कि वह हानियों की पूर्ति करे। इस पूर्ति की कई रीतियाँ हैं। एक तो यह कि हानि उठानेवाले को कुछ मुद्राएँ देकर क्षतिपूति की जाय। अत: क्षतिपूति वह वस्तु है जिससे प्रतिवादी के कर्तव्योल्लंघन से हुई हानि की पूर्ति उसके ही द्वारा वादी को दी जानवाली एक निश्चित धनराशि से की जा सके|
